Poetic CENSURE
. The above complaint was ï¬led against Kathleen M Kitt, 'an attorney licensed to practice
lewin Tennessee, alleging certainacts of misconduct. Pursuant to Supreme Court Rule 9, the
Board of Professional Responsibility considered these matters at its meeting on September â10,
2010. 4 â
â Respondent missed a March ZIB, 2009, stamte of limitations on a workersâ compensation
case despite having been notified on three occasions of offers of settlement, to which Respondent
did not tespond. Respondent did not advise the client that the statute of limitations had expired _ â
until March 24, .2010, despite being sent letters from the insurance carrier detect June 9, 2009,
and November 9, 2009, advising the Respondent that the statute'of limitations had lapsed and all
offers were withdraw. These actionsere in violation of RFC} 1.1, 1.3; and 1.4.
By the aforententioned facts, Kathleen M. Kitt has triolatecl Rules of Professional
Conduct RPC 1.1 (competence), 1.3 (diligence), and 1.4 (communication) and is hereby Publicly
Ceneuxed for these violations.
