JUDGMENT

This case was heard upon the record on appeal from the Chancery Court for
Williamson County, the briefs of the parties, and the argument of counsel. Upon
consideration thereof, this Court holds that the sanction issued by the hearing panel of the
Tennessee Board of Professional Responsibility for Michael Gibbs Sheppard’s violation
of Rules 1.15 and 8.4 of the Tennessee Rules of Professional Conduct was supported by
material and substantial evidence and was not arbitrary, capricious, or characterized by an
abuse of discretion.

In accordance with the opinion filed herein, it is, therefore, ordered and adjudged
that the judgment of the Chancery Court for Williamson County is reversed and the
decision of the hearing panel to suspend Mr. Sheppard for sixty days, to be followed by
two years of probation under the supervision of a practice monitor, and the requirement
to complete fifteen hours of continuing legal education on law office management and
trust accounting procedure, is affirmed. The costs of this cause are taxed to the Board of
Professional Responsibility of the Supreme Court of Tennessee.
