CHATTANOOGA LAWYER CENSURED

Bruce H. Guthrie, II, a Chattanooga attorney, received a Public Censure from the Board
of Professional Responsibility on May 11, 2004. In Mr. Guthrie’s representation of a client with
an asbestosis claim, Mr. Guthrie filed the claim as a global plaintiff in a pending lawsuit, as
opposed to filing an individual lawsuit on behalf of the client. Mr. Guthrie failed to explain the
matter to the client to the extent reasonably necessary to permit the client to make an informed
decision regarding the representation. In his representation of another client, Mr. Guthrie
appeared before a child support referee on behalf of a client with the strong odor of alcohol on
his breath. Mr. Guthrie’s conduct violated DR 1-102(A)(5)(6), DR 6-101, and DR 7-101(A)(3)
of the Code of Professional Responsibility.

A Public Censure is a form of public discipline which declares the conduct of the lawyer
improper but does not limit the lawyer’s right to practice.
