NASHVILLE ATTORNEY CONDITIONALLY CENSURED
On January 13, 2006, Charles William Cherry, of Nashville, Tennessee received a
Conditional Public Censure from the Supreme Court of Tennessee. Cherry submitted a
Conditional Guilty Plea in exchange for the Public Censure.
The Board of Professional Responsibility filed a Petition for Discipline and
Supplemental Petition for Discipline against Cherry pursuant to Rule 9, Rules of the Supreme
Court of Tennessee. Cherry through counsel submitted a Guilty Plea in exchange for receiving
the Conditional Public Censure. The Supreme Court of Tennessee publicly censured Cherry for
failing to keep adequate time records to support billing claims filed by Cherry with the
Administrative Office of the Courts (AOC). Cherry entered into a settlement agreement with
AOC on approximately August 23, 2005. The Tennessee Supreme Court censured Cherry based
upon Cherryâs compliance with the settlement agreement with AOC. In the event that Cherry
does not comply with his settlement agreement with AOC and pay the Board of Professional
Responsibility for the costs and expenses of this disciplinary proceeding, then Cherryâs Public
Censure shall be revoked and the Board of Professional Responsibility may file a Petition for
Discipline against Cherry based upon his non-compliance. This Censure declares Cherryâs
actions to be improper ethical conduct but does not limit Cherryâs right to practice law.
