DAVIDSON COUNTY LAWYER CENSURED

On May 14, 2009, Nathaniel Koenig, who practices law in Tennessee, received a Public Censure from
the Board of Professional Responsibility of the Tennessee Supreme Court.
In September, 2005, Complainant retained Respondent to draft and enter two (2) Qualified Domestic
Relations Orders (QDRO) that were ordered pursuant to a Final Decree of Divorce. Complainant contacted the
Respondent on numerous occasions about the status of the QDROs, but received no response from Respondent.
Respondent finally drafted and entered the first QDRO on August 3, 2006. This QDRO was approved by the
plan administrator. Respondent drafted and entered the second QDRO on February 27, 2007. The QDRO was
rejected by the plan administrator. On April 26, 2007, Respondent e-mailed Complainant and stated that he
would submit a QDRO “again and again until they approve it.” Complainant continued to write letters to
Respondent requesting a status of completion and it was not until Complainant called the plan administrator
herself in October, 2007, that Complainant realized Respondent had not submitted any subsequent QDROs for
approval by the plan administrator. Likewise, Respondent has not responded to correspondence from
disciplinary counsel requesting information or updates in the case. Respondent has not taken any court action
on behalf of Complainant since February 27, 2007. By the aforementioned facts, Nathaniel Koenig, has
violated Rules of Professional Conduct 1.3, 1.4(a), and 3.2, and is hereby Publicly Censured for these
violations.
A Public Censure is a rebuke and warning to the attorney, but it does not affect the attorney’s ability to
practice law.
