GREENEVILLE LAWYER CENSURED

Francis X. Santore, Jr., of Greeneville, was publicly censured by the Board of Professional
Responsibility on October 13, 2008. The censure was issued by the Board pursuant to Rule 9, Section 8 of the
Rules of the Tennessee Supreme Court. Santore did not request a hearing on the matter.

The Respondent had filed suit in a case arising from an automobile collision. After the defendant
evaded service of process for several months, the Respondent left a voicemail message on the defendant’s
phone advising her to accept service and contact the attorney for the uninsured motorist insurance carrier. The
voicemail was angry and expletive-ridden, included a threat to have the defendant arrested, and could be
construed as threatening physical harm.

The Respondent’s conduct violated Rules of Professional Conduct 4.4(b), and 8.4(b) and (e). Some
factors, including absence of dishonest or selfish motive, full and free disclosure to the Board, cooperative
attitude, and remorse, were considered in mitigation. For his violations, the Respondent received a Public
Censure from the Board.

A Public Censure is a rebuke and warning to the attorney, but it does not affect the attorney’s ability to
practice law.
