KNOXVILLE ATTORNEY CENSURED
On November 4, 2005 the Board of Professional Responsibility censured Bruce E. Poston
of Knoxville. The censure was issued pursuant to Rule 9, Rules of the Supreme Court of
Tennessee. Mr. Poston did not request a hearing. The censure does not prevent Mr. Poston from
continuing to practice law.
Mr. Marcus Branner was convicted of two counts of attempted second degree murder.
His attorney was Bruce Poston. Despite Mr. Brannerâs request, Mr. Poston never filed an appeal.
When Mr. Brannerâs complaint was filed with the Board, Mr. Poston stated he would file a
delayed appeal. He further failed to respond to Disciplinary Counselâs inquiries as to the status
of Mr. Brannerâs case. Mr. Branner ultimately filed a post-conviction petition, but he was late in
doing so and his petition was time-barred.
Mr. Poston has thereby violated RPC 1.1, 1.3, 1.4, and 8.4(d) of the Tennessee Rules of
Professional Conduct.
