Public censure on May 10, 1989. He represented a client in a worker's compensation action in
1983, filed the complaint on November 28, 1983, service of process was had on November 30,
1983; however, the case was dismissed in October 1984 for failure to prosecute. When the client
made inquiry as to the status on various occasions, Cate indicated the suit was filed and the client
would have to wait until the matter was heard. The client found out in 1987 from the Clerk &
Master that the case was dismissed.
