DAVIDSON COUNTY LAWYER CENSURED
On October 22, 2010, Yvette Y. Cain, an attorney licensed to practice law in Tennessee, received a
Public Censure from the Board of Professional Responsibility of the Tennessee Supreme Court.
Ms. Cain represented a client in a post-divorce child support modification proceeding. The parties
reached an agreement, and on July 6, 2005, Ms. Cain forwarded a proposed order to the clerk for entry with
the court. Ms. Cain failed to monitor entry of the order with the court and discovered in August, 2006, that
the order had been misplaced by the clerk and was never signed by the judge. Ms. Cain failed to act with
reasonable diligence and the order was not actually signed by the judge until May 19, 2009. During the
interim, Ms. Cain failed to reasonably communicate with her client about the status of the order.
By these acts, Yvette Y. Cain has violated Rules of Professional Conduct RPC 1.3 (diligence) and
1.4 (communication), and is hereby, publicly censured for these violations. A Public Censure is a rebuke
and warning to the attorney, but it does not affect the attorneyâs ability to practice law.
