DAVIDSON COUNTY LAWYER CENSURED
On September 24, 2010, Kathleen M. Kirt, an attorney licensed to practice law in Tennessee,
received a Public Censure from the Board of Professional Responsibility of the Tennessee Supreme Court.
Ms. Kirt permitted a March 28, 2009, statute of limitations on a workersâ compensation case to
lapse, despite having been notified on three occasions of offers of settlement, to which Ms. Kirt did not
respond. Ms. Kirt did not advise the client that the statute of limitations had expired until March 24, 2010,
although she had been sent letters by the insurance carrier dated June 9, 2009, and November 9, 2009,
advising Ms. Kirt that the statute of limitations had lapsed and all offers of settlement were withdrawn.
By these acts, Kathleen M. Kirt has violated Rules of Professional Conduct 1.1 (competence), 1.3
(diligence), and 1.4 (communication) and is hereby, publicly censured for these violations. A Public
Censure is a rebuke and warning to the attorney, but it does not affect the attorneyâs ability to practice law.
