The above complaint was ï¬led against Kevin Terry, an attorney licensed to practice law
in Tennessee, alleging certain acts of nnsconduct. Pursuant to Supreme Court Rule__9_, theâBoardâ .
of Professional Responsibility considered these matters at its meeting on March 12, 2010.
In July of 2009, the Respondent drafted a check on his trust account, but there were not
sufï¬cient funds in the trust account to cover the check, and an overdraft resulted. In August and
September of 2009, additional checks were presented for payment that the Respondent had
drawn on the mist account, which resulted in a larger overdraft balance. The Keepondent
admitted that his personal money was in his trust account. A review of the Respondentâs trust
account records revealed that in August and September of 2009, the. Respondent wrote multiple
checks on the trust account for personal items. The Respondent asserts that the trust account has
not contained any client money for some time, and that he did not misappropriate any client
money.
By the aforementioned facts, Kevin Terry has violated Rule of Professional Conduct 1.15
(safekeeping property) and is hereby Publicly Censored for this violation.
