NASHVILLE ATTORNEY PUBLICLY CENSURED

Paul J. Walwyn, a Nashville attorney, was publicly censured by the Supreme Court of
Tennessee on June 19, 2006.

The Board of Professional Responsibility filed a Petition for Discipline, a Supplemental
Petition for Discipline and a Second Supplemental Petition for Discipline against Walwyn
pursuant to Rule 9, Rules of the Tennessee Supreme Court. Walwyn submitted a Conditional
Guilty Plea in exchange for a stated form of discipline.

Walwyn admitted his guilt of failing to timely respond to Disciplinary Counsel in
violation of Rule 8.4(a)(d) of the Tennessee Rules of Professional Conduct.

On June 19, 2006, the Tennessee Supreme Court entered an Order publicly censuring
Walwyn for violation of these rules. The Court further ordered that Walwyn shall engage
attorney John Kitch to do a law practice management evaluation, at Walwyn’s own expense, and
implement the recommendations made by John Kitch and certify the same to Disciplinary
Counsel; and the Court further ordered that Walwyn shall audit the law practice management
course at the Nashville School of Law and successfully complete the exam; and Walwyn shall
complete six (6) hours of continuing legal education on subjects related to client relations, the
management of a law practice, Rules of Professional Conduct on disciplinary action of the Board
of Professional Responsibility in addition to the mandatory fifteen (15) hours required in 2006.

Finally, the Court ordered that Walwyn pay costs in the matter.

The censure declares Walwyn’s actions to be improper ethical conduct, but does not limit
Walwyn’s right to practice law.
