MORGAN COUNTY LAWYER CENSURED
On July 21, 2010, Andrew N. Hall, an attorney licensed to practice law in Tennessee, received a
Public Censure from the Board of Professional Responsibility of the Tennessee Supreme Court.
Mr. Hall was contacted by a prison inmate regarding a post-conviction matter. Mr. Hall requested
$500 to go to the prison for a consultation, which was paid. On October 20, 2009, Mr. Hall visited the
inmate and discussed representation on a Writ of Certiorari to be filed in Chancery Court. Mr. Hall
received the balance of the $3,500.00 retainer on October 21, 2009, and had his assistant draft the Petition.
On October 29, 2009, Mr. Hall reviewed and approved the Petition. The Petition was forwarded to the
court for filing. Mr. Hall did not have the inmate/petitioner sign or swear to the Petition, as required by
statute and case law. The adversary filed a Motion to Dismiss. Since the time to cure the failure of inmate
signature had lapsed, the case was dismissed on January 21, 2010.
By these acts, Andrew N. Hall has violated Rules of Professional Conduct 1.1 (competence) and 1.3
(diligence), and is hereby Publicly Censured for these violations. A Public Censure is a rebuke and
warning to the attorney, but it does not affect the attorneyâs ability to practice law.
