NASHVILLE LAWYER REINSTATED TO THE PRACTICE OF LAW

On January 28, 2004, the Supreme Court of Tennessee entered an order reinstating Ted A.
Burkhalter to the practice of law subject to certain conditions. On March 24, 2003, Ted A.
Burkhalter filed a petition requesting that his license to practice law be reinstated. On
October 15, 2003 the Hearing Committee heard Burkhalter’s petition for reinstatement. The
Hearing Committee recommended granting Burkhalter’s request for reinstatement upon certain
conditions. The Supreme Court entered an Order on January 28, 2004 reinstating the license of
Burkhalter upon conditions precedent and subsequent, the violation of which may lead to the
summary revocation of his law license.

As a condition precedent to reinstatement, Burkhalter shall set up a trust account in accordance
with the Rules of Professional Conduct, and shall provide notice and supporting documentation
evidencing the account to Disciplinary Counsel on or before February 1, 2004, which Burkhalter
has completed.

For a period of twenty-four months beginning February 1, 2004, Burkhalter shall submit all
account statements and monthly reports to the Board in care of Disciplinary Counsel; and during
the calendar years 2004 and 2005, Burkhalter shall complete no less than four (4) hours of
Continuing Legal Education (CLE) coursework per year that specifically addresses the legal
requirements for IOLTA or other client accounts in Tennessee, or an appropriate multistate CLE
course which addresses such issues. On or before December 31 of each year, Burkhalter shall
submit to the Board in care of Disciplinary Counsel a true copy of the syllabus or registration
form indicating the (i) substance of the coursework and (ii) confirmation that said coursework
has been completed. The Court further ordered that failure to comply with these conditions shall
constitute grounds for suspension.
