MEMPHIS LAWYER SUSPENDED
On June 28, 2011, Alicia Howard of Memphis, Tennessee, was suspended by the Tennessee Supreme
Court for a period of eighteen (18) months with the first six (6) months being active suspension and the
remaining twelve (12) months of probation with a practice monitor, pursuant to Rule 9, Section 8.5. The
Supreme Court further ordered Ms. Howard to contact the Administrative Office of the Courts (AOC) and
comply with any and all requests by the AOC for reimbursement of fees paid by them for work not performed
by Ms. Howard.
Ms. Howard violated the Rules of Professional Conduct by failing to timely file a Petition and signing
and notarizing her clientâs signature to the Petition without indicating the clientâs permission to do so in
violation of Rule 3.3 (candor to the tribunal); 3.4 (fairness to opposing party); 4.1 (truthfulness); and 8.4
(misconduct). In a second complaint, Ms. Howard submitted fee applications to the AOC billing for work not
performed by Ms. Howard in violation of Rule 1.5 (fees); 5.5 (unauthorized practice of law); and 8.4
(misconduct).
Ms. Howard was ordered to pay the expenses and costs of the disciplinary proceeding against her
pursuant to Rule 9, Section 4.7 of the Rules of the Supreme Court and was ordered to fully comply in all
respects with the requirements and obligations of suspended attorneys as set forth in Rule 9, Section 18.1 of
the Rules of the Supreme Court.
