PUBLIC CENSURE
The above complaint was ï¬led against James Daniel Marshall, #25541, an attorncy
licensed to practice law in Tennessee, alleging certain acts of misconduct. Pursuant to Tenn.
Sup. Ctâ R. 9, the Board ofProlbssional Responsibility considered these matters at its inestinglon
September 9, .2016.
Mr. Marshall represented a client in pursuing a personal injury claim. Mr. Marshall did
very little work on the case after ï¬ling suit. The Court dismissed the lawsuit for failure to
prosecute. Mr. Marshall failed to appear in Court or respond to the Courtâs motion to dismiss.
Mr. Marshall also failed to keep his client informed about the status of the representation
By, these acts, James Daniel Marshall has violated Rules of Professibnal Conduct 1.1
(competence), 1.3 (diligence), and 1.4 (communication) and is hereby Publicly Censured for
these violations.
