JOHNSON CITY LAWYER CENSURED

On April 7, 2008, Mitchell Stanley Givens, of Johnson City, Tennessee, received a Public Censure from
the Tennessee Supreme Court.

The Board of Professional Responsibility filed a Petition for Discipline against Mr. Givens pursuant to
Rule 9, Rules of the Supreme Court of Tennessee. Mr. Givens submitted a Conditional Guilty Plea agreeing to
accept a Public Censure. Mr. Givens failed to adequately communicate with clients on several critical issues
such as the viability of an appeal, timely closure of an estate, and failing to return phone calls to counsel on
another estate matter. Further, he failed to inform the Court of Appeals that he was no longer representing a
client. Mr. Givens’ actions were a violation of Rules 1.1, 1.3, 1.4(a) and (b), and 8.4 of the Tennessee Rules of
Professional Conduct. Mr. Givens is also ordered to pay to the Board of Professional Responsibility expenses
and costs of this matter.

For these violations, the Supreme Court of Tennessee publicly censures Mitchell Stanley Givens. This
censure declares Mr. Givens’ conduct to be improper, but does not limit his right to practice law.
