MEMPHIS LAWYER PUBLICLY CENSURED

Barry E. Gilmore, of Memphis, was publicly censured by the Board of
Professional Responsibility on March 13, 2006. The censure was issued by the
Board pursuant to Rule 9, Section 8 of the Rules of the Tennessee Supreme
Court. Gilmore did not request a hearing on the matter.

In three complaints filed against Gilmore in 2005, the Board found that he
seriously neglected and failed to move with reasonable diligence in his clients’ legal
matters, and that he had been persistently dilatory in meeting his commitments to
clients and to the Board.

The Board also found that Gilmore had failed to inform his clients that he
abandoned his prior law office and moved his practice to his home in June or July of
2005 due to his depression, and that he did not communicate with his clients further
regarding their legal matters.

Gilmore’s license is currently subject to an order of temporary suspension
entered by the Tennessee Supreme Court on February 21, 2006 given that his
continued practice poses a risk of irreparable harm to the public.
