CHATTANOOGA LAWYER CENSURED
On January 8, 2009, James A. Hurst, Jr., of Chattanooga, Tennessee, received a Public Censure from the
Tennessee Supreme Court.
The Board of Professional Responsibility filed a Petition for Discipline against Mr. Hurst pursuant to
Rule 9 of the Rules of the Supreme Court of Tennessee. Mr. Hurst submitted a Conditional Guilty Plea that was
approved by the Hearing Panel, the Board and the Supreme Court. Mr. Hurst violated the Rules of Professional
Conduct by paying inadequate attention to his clientâs collection case and misleading his client as to the status
of the case. Also, Mr. Hurst failed to respond to the repeated requests of Disciplinary Counsel. Hurstâs actions
violated the following Rule(s) of Professional Conduct: 1.1 (Competence), 1.2 (Scope of the Representation
and the Allocation of Authority Between the Lawyer and Client), 1.3 (Diligence), 1.4 (Communication), and
8.4 (a)(Misconduct). Mr. Hurst is further ordered to pay the costs of the disciplinary proceedings.
For these violations, the Supreme Court of Tennessee publicly censures James A. Hurst, Jr. A public
censure is a rebuke and warning to the attorney, but it does not affect the attorneyâs ability to practice law.
