PUBLIC CENSURE

The above complaint was filed against Kimberly Cross Shields, an attorney liCensed to

practice law in Tennessee, alleging certain acts ofmisconduct. Pursuant to Tenn. Sup. Ct. R. 9, the

Board of Professional Responsibility considered thesematters at its meeting on March 11, 2016.

Ms. Shields made misrepresentations and omissions to the court by stating that her former

husband was subject to an enforceable mediation agreement and by failing to advisethe court, that her

children were unable to manage their own trust funds due to the terms of a controlling trust agreement.

Ms Shields further entered an exparte order with the court without. agreement of opposing counsel.

By these acts, Kimberly Cross Shields has violated Rules ofl’rofessional Conduet 3 .3 {candor

toward tribunal), 3.509) (impartiality and decorum of tribunal), 44(21) (respect for
