MEMPHIS LAWYER SUSPENDED
On March 24, 2009, Kathleen L. Caldwell, of Memphis, Tennessee, was suspended from the practice
of law by the Tennessee Supreme Court for twenty-four (24) months, with six (6) months served as active
suspension, followed by the remaining eighteen (18) months served on probation. While on probation,
Caldwell shall not violate the Rules of Professional Conduct and shall report to a practice monitor, approved
by Disciplinary Counsel, who shall report to the Board of Professional Responsibility on a monthly basis.
The Board of Professional Responsibility filed a Petition for Discipline on March 21, 2005 against
Ms. Caldwell. The Board subsequently filed four (4) Supplemental Petitions for Discipline against Ms.
Caldwell alleging that Caldwell had failed to supervise a support person in her law office and was unaware
of lawsuits, clients and funds generating from her law office. Caldwell submitted a Conditional Guilty Plea
which was accepted and approved by a Hearing Panel, the Board and the Tennessee Supreme Court. Ms.
Caldwellâs actions violated Disciplinary Rules and Rules of Professional Conduct 1.1 (competence); 1.2
(scope of representation); 1.3 (diligence); 1.4 (communication with clients); 1.15 (safekeeping of property);
3.4 (fairness to opposing party and counsel); 5.3 (responsibilities regarding non-lawyer assistance); 8.4
(misconduct). Ms. Caldwell must comply with Section 18 of Rule 9, Rules of the Supreme Court, regarding
obligations and responsibilities of suspended attorneys.
