SULLIVAN COUNTY LAWYER SUSPENDED
Effective June 25, 2026, the Supreme Court of Tennessee suspended Samuel Ervin from the practice of
law for six (6) years pursuant to Tennessee Supreme Court Rule 9, Section 12.2, with four (4) years active
suspension, and the remainder served on probation with conditions pursuant to Tennessee Supreme Court Rule
9, Section 14.1.
A Petition for Discipline containing two (2) disciplinary complaints was filed by the Board. In the first
matter, Mr. White failed to comply with a Tennessee Supreme Court reinstatement order imposing numerous
conditions including engaging a practice monitor and submitting the required practice monitor reports and
engaging a certified public accountant to review his trust account and submit a report. In the second matter, Mr.
White repeatedly misled his client to believe a petition had been filed and set for hearing. In addition, Mr. White
delayed over two (2) years filing the petition for which he was retained and failed to promptly refund the retainer
as represented to his client.
Mr. White executed a conditional guilty plea acknowledging his conduct violated Tennessee Rules of
Professional Conduct 1.1 (competence), 1.3 (diligence), 1.4 (communication), 1.5(d) (fees), 1.16 (terminating
representation) 3.2 (expediting litigation), 3.4 (fairness to opposing party and counsel), and 8.4 (misconduct)
Mr. White must comply with the requirements of Tennessee Supreme Court Rule 9, Sections 28 and 30.4,
regarding the obligations and responsibilities of suspended attorneys and the procedure for reinstatement.
