CLARKSVILLE LAWYER TEMPORARILY SUSPENDED
On February 8, 2002, the Supreme Court of Tennessee issued an order summarily and
temporarily suspending Theodore B. Hayâs license to practice law, upon finding that Mr. Hay
had failed to answer the Board of Professional Responsibilityâs requests for information regarding a
complaint of misconduct. Section 4.3 of Supreme Court Rule 9 provides for the immediate summary
suspension of an attorneyâs license to practice law in cases of failing to respond to the Board of
Professional Responsibility. Disciplinary Counsel filed a petition with the Supreme Court alleging that
Mr. Hay had failed to respond to the Boardâs requests for information regarding a complaint.
The February 8, 2002 order precludes Mr. Hay from accepting any new cases effective February 8, 2002.
Mr. Hay must cease representing existing clients effective March 10, 2002. After March 10, 2002 Mr.
Hay shall not use any indicia of lawyer, legal assistant, or law clerk nor maintain a presence where the
practice of law is conducted.
The order requires Mr. Hay to notify by registered or certified mail all clients being represented in pending
matters, as well as co-counsel and opposing counsel of the Supreme Courtâs order suspending his law
license. Section 18 of Supreme Court Rule 9 requires Mr. Hay to deliver to all clients any papers or
property to which they are entitled.
This suspension remains in effect until dissolution or modification by the Supreme Court. Mr. Hay may for
good cause request dissolution or modification of the suspension by petition to the Supreme Court.
