FRANKLIN LAWYER ON PROBATION
On September 13, 2011, the Tennessee Supreme Court suspended Thomas Holland McKinnie, of
Franklin, Tennessee, for two (2) years; however, the entire period of suspension will be probated. While on
probation, Mr. McKinnie is required to perform three (3) hours of pro bono service each month during the
probationary period and to attend an additional three (3) hours of continuing legal education each year of the
probationary period.
The Board of Professional Responsibility filed a Petition for Discipline against Mr. McKinnie pursuant
to Rule 9 of the Rules of the Supreme Court of Tennessee alleging that Mr. McKinnie improperly deposited
checks between his attorney trust account and a personal account. He had insufficient funds in both accounts
during all of the transactions which ultimately resulted in a loss to First Tennessee Bank in the amount of
$7,500.00. No clients were harmed by his misconduct. Mr. McKinnie was ordered by the Williamson County
Circuit Court to pay restitution and complete 100 hours of community service. He has complied with the terms
of the Order.
A Hearing Panel determined that Mr. McKinnieâs actions violated Rules of Professional Conduct
1.15(a), Safekeeping Property and 8.4(a) and (c), Misconduct.
