CLARKSVILLE LAWYER CENSURED
On January 9, 2008, Patricia A. Rust, of Clarksville, Tennessee, received a public censure from the Board of
Professional Responsibility for her violation of Rule of Professional Conduct 8.4(d). Rust represented a client in a
child custody matter. She filed a motion to stay the proceedings under the Service Members Civil Relief Act. The
motion stated Rustâs client was deployed in Iraq and was not allowed any leave. The allegations were true when
made.
Rustâs client was allowed personal leave a few days prior to the hearing on the motion to stay and was in
Montgomery County on the day of the hearing. Rust did not inform the court of the clientâs presence in
Montgomery County on the day of the hearing, and argued for the stay. It was Rustâs understanding that the client
remained âdeployedâ even though on temporary leave. Rust admits that she made a misleading statement to the
court. Rust also admits that she signed a certificate of service for a pleading that was not properly delivered.
Rust was publicly censured for the violations described above.
