The above complaint was ï¬led against Robert Elliott McGuire, #21594, an attorney
licensed to practice law in Tennessee, alleging certain acts of misconduct. Pursuant to Tenn. Sup.
Ct. R. 9, the Board of Professional Responsibility considered these matters at its meeting on March
9,2018. I
In October of 2013, Mr. McGuire made statements in the rebuttal closing argument of a
criminal prosecution that referenced material which had been excluded by the trial court in a preâ
trial Order. Further, the statements were inappropriate, served no legitimate purpose, and resulted
in reversal 'of the conviction by the Court of Criminal Appeals,

By the aforementioned acts, Robert Elliott McGuire has violated Rule of Professional
Conduct 3.4(0) (disobey rules of tribunal) and 8.4(d) (conduct prejudicial to administration of _
justice) and is hereby Publicly Censured for these violations.
