MEM PHIS LAWYER ON PROBATION
On May 3, 2004, the Supreme Court of Tennessee entered an Order suspending the law
license of Gerald S. Green for a period of six months, with all time suspended and six months to
be served on probation.
Green neglected his clientsâ legal matters; charged an excessive fee; failed to withdraw
when discharged by a client, and failed to deliver to the client all papers and properties to which
the client was entitled; failed to represent a client competently; and neglected client matters and
failed to adequately communicate with clients, and failed to return client property.
Disciplinary Counsel filed petitions for discipline pursuant to Rule 9, Rules of the
Tennessee Supreme Court. Green agreed to enter into a conditional guilty plea to the petitions in
exchange for a suspension of six (6) months with all time suspended and Green serving the six
(6) months on probation. During the period of suspension and/or probation Green will be
prohibited from accepting any new legal assignments for the six months during which time
Green agrees to work only on his present caseload; Green has agreed to follow all of the
recommendations of Legal Management Services, Inc., which evaluated his practice and made
recommendations in a written report; Green agreed to submit monthly reports to Disciplinary
Counsel from Legal Management Services, Inc., evidencing his compliance and Green has
agreed to refund all attorneyâs fees paid to him relating to the pending complaints by the
following parties: Patricia Johnson, Sylvester Gray, David Watson, Susie Clay, Warline
Blakely, Keith Brooks and Cindy June Haney within the six (6) month suspension/probation
period.
Greenâs failure to comply with any of the conditions of probation shall result in the
Board, for good cause shown at any time within the six (6) months petitioning the Court to
revoke the probation and impose the remainder of the suspension.
The suspension/probation period shall be effective as of January 1, 2004.
