MEMPHIS LAWYER SUSPENDED FROM PRACTICE OF LAW

David D. James, Jr., a Memphis attorney, has been temporarily suspended from
the practice of law in this state by an Order of the Supreme Court of Tennessee entered
on June 16, 2004. The Court suspended Mr. James based upon a petition filed by the
Board of Professional Responsibility alleging that he failed to respond to Disciplinary
Counsel or to the Board concerning a complaint of misconduct.

This suspension was issued pursuant to Section 4.3 of Tennessee Supreme
Court Rule 9, which requires, in part, attorneys to respond to complaints filed by the
Board. Mr. James’ law license is currently inactive and has been inactive since June 23,
2003, upon his own request.

He is prohibited within the June 16, 2004 suspension order from practicing law in
any form in Tennessee due to the inactive status of his law license and is prohibited from
being returned to active status until he obtains dissolution or modification of this
temporary suspension order from the Tennessee Supreme Court. Mr. James shall
furthermore not use any indicia of lawyer, legal assistant or law clerk and shall not be
present in or staff an office where the practice of law is conducted, pursuant to the June
16, 2004 suspension order.

Tennessee Supreme Court Rule 9, Section 18, and the Court’s order require Mr.
James to notify by registered or certified mail all clients represented in pending matters,
all co-counsel and opposing counsel of the Supreme Court’s Order suspending him.
Section 18 also requires Mr. James to deliver to all clients any papers or property to
which they are entitled.

This suspension shall remain in effect indefinitely until it is dissolved or amended
by order of the Tennessee Supreme Court.
