BOARD OF PROFESSIONAL RESPONSIBILITY
January 3, 2002
MEMPHIS LAWYER SUSPENDED BY SUPREME COURT
By Order of the Supreme Court of Tennessee filed December 21, 2001, Clifford Edward Whitaker's license to practice law was
temporarily suspended, pursuant to Section 4.3 of Rule 9, Rules of the Supreme Court of Tennessee, upon a finding that Mr. Whitaker
had failed to respond to the Board of Professional Responsibility concerning complaints of misconduct and that he posed a threat of
irreparable harm to the public.
The December 21, 2001, Order precludes Mr. Whitaker from accepting any new cases effective December 21, 2001. Mr. Whitaker
may continue to represent existing clients for thirty days. Mr. Whitaker must cease representing existing clients effective January 20,
2002. After January 20, 2002, Mr. Whitaker shall not use any indicia of lawyer, legal assistant, or law clerk, etc., nor maintain a presence
where the practice of law is conducted.
The Order requires Mr. Whitaker to notify by registered or certified mail all clients being represented in pending matters, as well
as co-counsel and opposing counsel, of the Supreme Court's Order suspending his law license. Section 18 of Supreme Court Rule 9
requires Mr. Whitaker to deliver to all clients any papers or property to which they are entitled.
This suspension remains in effect until dissolution or modification by the Supreme Court. Mr. Whitaker may for good cause
request dissolution or modification of this suspension by petition to the Supreme Court.
