Public censure on October 20, 1998. While representing a client and after being paid for such
representation, he failed to set up a trust account and failed to provide the client with an
accounting after the client disputed whether or not Gardner performed the duties for which he
was paid. In another matter, he failed to communicate properly to his client the status of the case
and the extent of duties performed in the case.
