GREENEVILLE ATTORNEY CENSURED

On January 26, 2004, the Board of Professional Responsibility publicly censured Lawrence A.
Welch, Jr., of Greeneville, Tennessee. Welch was given notice of the censure and did not
request a hearing. A client consulted with Welch regarding a legal malpractice case but then
Welch failed to return to the client his file. Disciplinary Counsel for the Board wrote Welch four
letters requesting Welch to provide the Board of Professional Responsibility with a copy of the
client’s file so that the file could be forwarded to the client. Welch failed to respond to
Disciplinary Counsel’s letters and failed to provide either the client or the Board with the client’s
file. Welch’s failure to provide his client with his file and failure to respond to the Board’s
request that Welch turn over the file violates DR 1-102(A)(1)(5) and (6); DR 2-110(A)(3), and
DR 9-102(B)(4) of the Code of Professional Responsibility. The Board of Professional
Responsibility of Tennessee publicly censures Welch and declares Welch’s actions to be
improper conduct.
