PUBLIC CENSURE

The above complaint was filed against Al H. Thomas, #8846, an attorney licensed to

practice law in Tennessee, alleging certain acts of misconduct. Pursuant to Tenn. Sup. Ct. R. 9,

the Board of Professional Responsibility considered these matters at its meeting on December 8,

2017.

Mr. Thomas was surety for the payment of court costs in a civil action. When the court

costs remained unpaid after the dismissal of the client’s lawsuit, the Court entered an order

requiring Mr. Thomas to appear and show cause, if any, why judgment should not be entered

against him for payment of the costs. Mr. Thomas failed to appear before the Court or provide

notice that he was unable to appear.

By these acts, A1 H. Thomas has violated Rules of Professional Conduct 3.4(0) (knowing

disobedience of an obligation under rules of a tribunal), and 8.4(d) (conduct prejudicial to the

administration ofjustice), and is hereby Publicly Censured for these violations.
