GERMANTOWN LAWYER SUSPENDED

On October 10, 2011, Donald Sutherland Holm, III, of Shelby County, Tennessee, was suspended by the
Tennessee Supreme Court for six (6) months, pursuant to Supreme Court Rule 9, Section 4.2.

On May 3, 2011, the Board of Professional Responsibility filed a Petition for Discipline against Mr.
Holm, pursuant to Supreme Court Rule 9. Mr. Holm submitted a Conditional Guilty Plea that was approved by
the Hearing Panel, the Board and the Supreme Court. Mr. Holm violated the Rules of Professional Conduct by
practicing law in Tennessee from August 2007 until November 24, 2010, while his law license was
administratively suspended.

Mr. Holm’s actions violated the following Rules of Professional Conduct: 5.5(a)(Unauthorized Practice
of Law) and 8.4 (a), (c), and (d) (Misconduct).

Mr. Holm was further ordered to pay the expenses and costs of the disciplinary proceedings against him,
pursuant to Supreme Court Rule 9, Section 24.3, and fully comply in all respects with the requirements and
obligations of suspended attorneys as set forth in Supreme Court Rule 9, Section 18.
