PUBLIC CENSURE
The above complaint was filed against Timothy Allen Price, an attorney licensed to
practice law in fonnessee, ailcging certain acts of misconduct. Pursuant to Supreme Court Rule
9, tho Board of Professional Responsibility considered this Inatter at its meeting on June 10,
2011.
The Respondent has abandoned his ptaotioo. On Dccombor 15, 2009, the Complainant
hired tho Rospondcnt to ptcporc and ï¬lo on application for Freedom of Information Act Request
anti to obtain a copy of the Complainantâs criminal record. The Complainant paici the
Respondent a ï¬at fee of $300.00 for his services and issued a separate check in. the amount of.
$700.00, payable to the Department of Homeland Security. chcvcr, the Rnspondcnt did not
forward this check to the Department of Homeland Scourity. Instead, be deposited it into his
operating account. The Complainantâs repeated attempts to contact the Respondent were
Lmsuoccsstâul. Tho Complainant was informed by the Department of Homeland Security that the
Freedom of Information Act Roquost was never ï¬led and the $700 foo was newer received. The
Respondent rcccntli' received a two year suspension for similar conduct.
By the aforelnontioncd acts, Timothy Allen Prion, has violated 1.3 (Diligence), 1.4
(Communication), 1.5 (Feea), 1.15 (Safekeeping Propel'tY). 1.16 (Declining and Terminating
Rspresentation), 8.1(Ba1' Admission and Disciplinary Matters), and 8.4 (Misconduct) of
Professional Conduct and is hereby Publicly Censured for these violations.
