LAWYER SUSPENDED AND CENSURED
On March 9, 2009, William Lawrence Embry, of Summerland Key, Florida, was suspended from the
practice of law in Tennessee for thirty-six (36) days with credit for thirty-six (36) days already served by Mr.
Embry while he was temporarily suspended in 2001. Further, Mr. Embry is publicly censured for the
unauthorized practice of law.
The Board filed a Petition for Discipline on June 27, 2003 and a Supplemental Petition on November 26,
2003 encompassing three complaints. The matter was heard before a duly appointed Hearing Panel on October
24-25, 2006, and May 14, 2007. Mr. Embry appealed the judgment of the Hearing Panel by filing a Petition for
Certiorari in Davidson County Chancery Court. The Chancery Court modified the Hearing Panelâs findings by
setting aside one complaint related to Mr. Embryâs failure to correct the court record in which Mr. Embry was a
defendant. The Chancery Court held that Respondent willfully failed to pay his child support obligations as
ordered by the Shelby County Circuit Court, and therefore, the prior period of temporary suspension of thirty-
six (36) days was appropriate. Further, the Chancery Court held that Mr. Embry engaged in the unauthorized
practice of law in Colorado by failing to indicate on his letterhead that he was not licensed in Colorado. For this
violation of the Disciplinary Rules, the Court modified the Hearing Panelâs sanction and imposed a public
censure.
Mr. Embryâs actions violate the following Disciplinary Rules and Rules of Professional Conduct: DR 1-
102(A)(1)(5)(6) and (7), Misconduct; DR 3-101(B), Aiding the Unauthorized Practice of Law; RPC 8.4 (a) and
(d), Misconduct.
