MEMPHIS LAWYER SUSPENDED
On May 5, 2011, William B. Penn of Memphis, Tennessee, was suspended by the Tennessee Supreme
Court for a period of three (3) years with two (2) years probated and one (1) year suspension, pursuant to Rule
9, Section 8.5 of the Rules of the Supreme Court. Prior to his reinstatement, Mr. Penn must pay restitution in
the amount of $36,040 to a former client and medical provider and pay the Boardâs costs.
Mr. Penn violated disciplinary rules by failing to preserve client confidences and secrets, failure to
safeguard client funds, and by taking an excessive unearned fee. Mr. Pennâs actions violated Tennessee
Supreme Court Rule 8, Disciplinary Rules (DR) 1-102 (Misconduct); DR 2-110 (Withdrawal from
employment); DR 4-101 (Preservation of client confidences and secrets); DR 7-102 (Representing a client
within the bounds of the law); and DR 9-102 (Preserving client funds).
Mr. Penn was further ordered to fully comply in all respects with the requirements and obligations of
suspended attorneys as set forth in Rule 9, Section 18.1 of the Rules of the Supreme Court.
