KNOXVILLE ATTORNEY PUBLICLY CENSURED
On November 29, 2007 a Public Censure was issued as to Attorney John T. Sholly, of
Knoxville, Tennessee.
The censure concerns two complaints. The first complaint relates to the period when Mr.
Sholly practiced law with Ms. Margaret Held. It appears that Mr. Sholly neglected a number of his
cases. He also maintained a personal trust account and did not practice the basic accounting
requirements for attorney trust accounts.
The second complaint relates to a single case in which Mr. Sholly represented an individual
charged with DUI. The client paid him $5000. The client terminated Mr. Shollyâs employment and
filed a fee dispute to get his money back. The fee dispute committee required Mr. Sholly to reimburse
the client $1500. Mr. Sholly has not complied with the fee committeeâs decision.
Mr. Sholly was thereby found to have violated RPC 1.3, 1.5, and 1.15 of the Rules of
Professional Conduct (Supreme Court Rule 8). The Board mailed notice of this censure to Mr. Sholly
and he did not request a hearing.
