SUPREME COURT OF TENNESSEE

Resporident, an attorney licensed
to practice law in Tennessee
(McNairy County)

PUBLIC- CENSURE

The above complaint was filed against Ross Neal Mitchell, an attorney licensed to practice

law in Tennessee, alleging certain acts ofmisconduct. Pursuant to Tenn. Sup. Ct. R. 9, the Board

of Professional Responsibility considered these matters at its meeting on September 11, 2015.

A client hired Mr. Mitchell to pursue a legal malpractice action against a former attorney.

Mr. Mitchell prepared a complaint and had the client sign the document. Thereafter, Mr. Mitchell

made multiple misrepresentations to his client, including that he filed the complaint, that there

were court hearings scheduled on three occasions, that mediation was scheduled on a particular

date, and that the lawsuit was successful, none of which were true. Five months after he was hired,

Mr. Mitchell left the law firm, and the client discovered that no lawsuit had been filed.

Mr. Mitchell has no prior discipline and made full and free disclosure of his actions to

Disciplinary Counsel.

Mr. Mitchell’s actions violate Rules of Professional Conduct 1.1 (competence), 1.3

(diligence), 1.4 (communication), and 1.16 (terminating representation). Mr. Mitchell further

violated Rule 8.4 (c) (dishonesty, misrepresentation) multiple times. Mr. Mitchell is hereby

Publicly Censured for these violations.
