Order
On May 9, 2003, the Court entered an order recognizing that with the adoption
of the Rules of Professional Conduct (replacing the Code of Professional
Responsibility), the time had come for an evaluation and review of disciplinary
enforcement in this state. The Court therefore established the Board of
Professional Responsibility Advisory Committee to undertake a comprehensive
review of the structure, function and operation of the Board. On May 12, 2003,
entered an order appointing the nine members of the Advisory Committee, who
were charged to review the relevant portions of Rule 9 and to consider such
other issues as were necessary to conduct a thorough, systematic review of the
disciplinary function of the Board. The Advisory Committee was chaired by Mr.
Waverly Crenshaw of the Nashville bar.
The Advisory Committee filed its report on June 15, 2004, in open court. The
Court thanks the nine members of the Advisory Committee for all their time,
hard work and dedication in preparing and presenting this report. The members
of the Committee have performed a valuable public service for which the Court
is grateful.
Due to the importance of the issues discussed in the Advisory Committee’s
report, the Court is placing the report and associated documents on the Court’s
website (www.tsc.state.tn.us)
for public inspection. The Court hereby solicits written comments concerning
the report from all interested parties, including members of the public,
lawyers and bar organizations, and members of the judiciary. All written
